01 · Wills

A will written once, kept under review when life changes.

Straightforward single wills from £660 inc VAT, complex wills (second marriages with separate beneficiary groups, estates including businesses or farms, trusts for children’s asset protection, residence nil-rate-band planning, charitable giving for IHT reduction, asset protection from care home fees) £840 to £1,140. Mirror wills for couples from £975. Drafted by David in person, signed and witnessed in our Queen Square office or at home, originals retained on the file.

02 · Lasting Powers of Attorney

Property and finance, plus health and welfare.

Drafting both LPAs (the property-and-finance LPA and the health-and-welfare LPA), with registration at the Office of the Public Guardian handled in-house. Both LPAs for an individual £900 inc VAT; both for a couple £1,320; single LPA £660 individual or £900 couple, plus the £92 OPG registration fee per LPA. Usually paired with a will at the same appointment so the family’s arrangements are made in one sitting.

About the firm

May 2021, after twelve years at Mowbray Woodwards, David sets up Whitworth Law on Queen Square.

David Lloyd Whitworth read Classics at Oxford, began his legal career in London, practised in Cheltenham and Cirencester, and settled in Bath seventeen years ago. He spent more than twelve years as head of the Wills, Trusts and Probate department at Mowbray Woodwards, the long-established Bath practice, including over a decade as an equity partner. On 7 May 2021 he registered Whitworth Law Limited at Companies House (number 13383059); SRA authorisation followed on 3 September.

The firm was set up deliberately small. One principal, one senior associate (Samantha Taylor, a first-class Cardiff law graduate, Fellow of CILEx and Accredited Lifetime Lawyer), one administrator (Jenny Noad). The point is the file does not move between fee earners and the same lawyer who signs the engagement letter is the lawyer who signs the Grant of Probate, even when that is years later. Some of David’s clients have now been with him for approaching twenty years.

Residence Nil-Rate Band, taper and downsizing

The Residence Nil-Rate Band can be worth up to £175,000 per spouse, but it tapers above an estate value of £2 million and the downsizing-addition rules trip clients up. We walk through the family home arithmetic, then draft the will to claim what is available without losing it to taper.

Trusts for children, second marriages and asset protection

Discretionary trusts for children’s asset protection, life-interest trusts for second marriages where each spouse has separate beneficiaries, and trusts to keep a share of the family home out of care-home means testing. Drafted in plain terms so the executors and trustees know what to do, charged at £390 inc VAT per hour with a fixed estimate first.

Estates with farms, businesses or charitable legacies

Agricultural Property Relief and Business Relief on qualifying farm or trading-business assets, charitable legacies to take an estate under the 36% reduced inheritance tax rate, and the practical detail of which assets to leave to which beneficiary so the tax sits in the right place. Most useful when the will is drafted alongside the LPAs, so the planning and the protection are made together.

How much does a will cost at Whitworth Law?

A reasonably straightforward single will is £660 inc VAT. Complex single wills (second marriages, business or farm assets, trusts for children, residence nil-rate-band planning, charitable giving, asset protection from care home fees) run £840 to £1,140 inc VAT. Mirror wills for couples start at £975, with complex mirror wills £1,170 to £1,650. An additional 25% applies if the will needs to be in place within two weeks. Every quote is fixed in writing before any drafting begins.

Will the same person handle my file from the first appointment through to signing or probate?

Yes. The firm has deliberately stayed at one principal and one senior associate so the lawyer who takes your instructions on day one is the lawyer who signs the will, registers the LPA, or applies for the Grant of Probate. There is no paralegal queue and the file does not get passed sideways. David runs wills, LPAs, tax planning and trusts; Samantha runs probate and estate administration.

Can a will and Lasting Powers of Attorney be done in the same appointment?

Yes, and most clients prefer it. We block one appointment to take instructions on the will and on both LPAs (property and finance, plus health and welfare), draft and post for review within the week, sign and witness in our Queen Square office at a second short appointment, and lodge the LPAs with the Office of the Public Guardian. OPG registration takes around eight to ten weeks; the will is signed sooner.

How long does probate take, and can I see a fee estimate before I instruct?

Samantha offers a free phone consultation before any retainer. On that call she will size up the estate, walk through a realistic timetable, and give a fee estimate inside the published ranges (Grant of Probate only £1,800 to £4,800 inc VAT; full estate administration £6,000 to £20,000). Straightforward grant-only cases usually take six to eight weeks; full administrations on more complex estates run six to twelve months from the Grant.

Where is the office, and is there parking?

We are at 18 Queen Square, Bath BA1 2HN, on the north side of John Wood the Elder’s Grade I listed Georgian square. Bath Spa railway station is a four-minute walk. On-street parking on the square itself is pay-and-display; the closest car parks are SouthGate and Charlotte Street. For elderly clients or anyone who cannot easily travel, we hold appointments at home in and around Bath by arrangement.
